Family law is not a sub- ject we think about until something impacts on our personal lives -- the breakdown of a relation- ship, for example, when our rights in relation to children, property and finances are suddenly brought into focus. We have developed an exper- tise in this area to cover things like resettling trust assets; retaining and varying the existing Trust; or winding up the Trust. All aspects need careful consideration if the client is to get a good result. We can also provide advice as to whether a family trust is appropri- ate. In many cases it is cheaper and more effec- tive for couples to sign a pre-nuptial agreement to protect assets, rather than setting up a family trust. Estate planning is important too. Nicolette says that often wills are out of date, or non- existent. Anyone with property worth more than $12,000 should have a will, other- wise the estate adminis- tration is more involved and expensive, and assets may go where they weren t intended. Schnauer and Co can assist in cases where a will is contested; where promises are not honoured or a child is excluded. Exclusions can be challenged, and the Court may rewrite the will to benefit the child. Particularly with sec- ond marriages or second relationships, it is important to get the ground rules agreed in a contract with your part- ner at the outset. Then review your contract and your wills every five years. Much extra legal cost and family difficulty is caused by people fail- ing to follow this simple advice, says Patricia Schnauer.
